Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Photomatch platform, including all related services, features, and content. By accessing or using Photomatch, you agree to be bound by these Terms.

1. Definitions

"Photomatch" refers to the platform, website, and all associated services operated by Photomatch.
"Photographer" refers to any user who creates an account to upload photos and manage events.
"Guest" refers to any individual who accesses an event gallery via a shared link to view or download photos.
"Event" refers to a photo gallery created by a Photographer on the platform.
"Content" refers to photos, images, and any other files uploaded to the platform.

2. Account Registration

To use Photomatch as a Photographer, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You must notify us immediately if you become aware of any unauthorized use of your account.

3. Acceptable Use

You agree to use Photomatch only for lawful purposes. You must not:

Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
Upload content that you do not have the right to distribute
Attempt to gain unauthorized access to any part of the platform or its infrastructure
Use automated tools to scrape, crawl, or extract data from the platform
Interfere with the performance or availability of the service
Use the platform to collect or harvest personal information of others without their consent

4. Content Ownership and Licensing

4.1 Your Content

You retain full ownership of all photos and content you upload to Photomatch. By uploading content, you grant Photomatch a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the service (face matching, gallery delivery, and photo viewing).

4.2 Responsibility for Content

You are solely responsible for the content you upload. You represent and warrant that you have all necessary rights and permissions to upload and share the content through Photomatch, including the consent of individuals depicted in the photographs where required by applicable law.

5. Face Recognition

Photomatch uses face recognition technology to match guest selfies with event photos. By using this feature:

Photographers acknowledge that face data (numerical descriptors) will be generated from uploaded event photos
Guests consent to having their selfie processed for face matching when they voluntarily take a selfie through the platform
Face data is scoped to individual events and is never shared across events or with third parties
Guest selfies are deleted immediately after the matching process completes

6. Privacy

Your use of Photomatch is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the platform, you consent to the practices described in the Privacy Policy.

7. Event Galleries and Access Control

Event galleries are private by default. Access is controlled through unique event links generated by the Photographer. The Photographer is responsible for managing who receives the event link.

Photomatch does not publicly list, index, or make galleries discoverable. However, we cannot prevent a guest from sharing an event link with others. Photographers should share event links responsibly.

8. Service Availability

We strive to maintain high availability of the Photomatch platform. However, we do not guarantee uninterrupted or error-free service. The platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Photomatch and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to:

Loss of data or photos
Unauthorized access to your account
Interruption of service
Errors in face recognition matching

Our total liability for any claim related to the service shall not exceed the amount you paid to Photomatch in the twelve months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Photomatch and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the platform, your content, or your violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in activity that we reasonably believe harms the platform or its users.

You may delete your account and all associated data at any time. Upon deletion, all events, photos, and face data associated with your account will be permanently removed.

12. Changes to These Terms

We may modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. Continued use of the platform after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in India.
